Suspension and Cancellation

The Certificate of Approval for the WSH Officer can be suspended or cancelled if the Authority is satisfied that such person:

  • Had obtained or procured his approval by fraud or misrepresentation;
  • Is in breach of any condition subject to which the approval was granted;
  • Is no longer a fit and proper person to act as a relevant authorised person;
  • It is in the public interest to do so.


Before suspending or cancelling the approval to act as WSH Officer, the Authority will:

  • Give the approved WSH Officer notice in writing for the intention of the Authority  to do so;
  • Specify a date, not less than 21 days after the date of the notice, upon which the suspension or cancellation shall take effect; and
  • Call upon the affected person to show cause to the Authority  why his/her approval as WSH officer should not be suspended or cancelled


If the person to whom a notice has been given;

  • Fails to show cause within the period of time given to him/her to do so or such extended period of time as the Authority  may allow; or
  • Fails to show sufficient cause

The Authority shall give notice in writing to that person of the date from which the suspension or cancellation of the approval shall take effect. Should the person is able to show sufficient cause to the Authority why his/her approval as WSH Officer should not be suspended or cancelled, the Authority shall not suspend or cancel the Certificate of Approval of the affected person.


A person whose approval as a WSH Officer has been suspended or cancelled may, within 14 days after the receipt of the notice, appeal in writing against the suspension or cancellation to the Minister, whose decision shall be final (Section 35, WSH Order, 2009). Where the Certificate of Approval is suspended, the person affected shall immediately cease performing any work in relation to the duties and powers of a WSH Officer.


The Certificate of Approval for approved WSH officer shall be surrendered within 7 days of the date of the cancellation (Section 36, WSH Order, 2009). Please refer to section 18.1 of this document for the process flowchart on the suspension and cancellation of application to act as a WSH Officer.


Any person who contravenes section 32, 36 or 37 of WSH Order 2009 is guilty of an offence and liable on conviction to a fine not exceeding $5,000, imprisonment for a term not exceeding 6 months or both.
