Legal Services Division (LSD)

FUNCTIONS

The Legal Services Division (LSD) plays a critical role in enabling SHENA to effectively discharge its statutory mandate by providing strategic legal support, strengthening regulatory frameworks, promoting sound corporate governance, and managing legal risks across the organisation. Through expert legal advice and services, the Division supports SHENA’s operational, support, and strategic functions, ensuring that regulatory decisions, policies, enforcement actions, and corporate activities are legally sound, transparent, and aligned with applicable national and international legal standards.

As the key enabler of SHENA’s regulatory effectiveness and governance excellence, the Legal Services Division continuously reviews, develops, and strengthens the legislative and regulatory framework governing workplace safety, health, environment, and radiation protection. Through proactive legal oversight, stakeholder engagement and regulatory stewardship, the Division safeguard SHENA’s interests while supporting the achievement of its strategic objectives and regulatory outcomes.

The responsibilities of the Legal Services Division include:

  • Initiating recommendations for, and drafting, new legislation and amendments to existing legislative frameworks, including the Safety, Health and Environment National Authority Act, the Workplace Safety and Health Act and its subsidiary legislation,  as well as the Radiation Protection Act and its subsidiary legislation.

  • Reviewing and vetting national policies, strategies, frameworks, and other policy instruments relating to workplace safety and health and radiation safety to ensure legal soundness, regulatory alignment, and consistency.

  • Drafting, preparing, and vetting contracts, agreements, and standard templates.

  • Drafting, preparing, and/or vetting legal documents and regulatory notices, including Stop Work Orders, Remedial Orders, Warning Letters, appointment of Warranted Inspectors and Authorised Officers, and SHENA publications such as Industry Guidance Notes (IGNs), Workplace Safety and Health Notices (WSHNs), and Radiation Technical Notes (RTNs).

  • Reviewing international agreements, conventions, and other legal instruments to ensure SHENA’s alignment with international obligations, standards, and best practices.

  • Reviewing investigation papers prior to their submission to the Public Prosecutor.

  • Supporting and assisting the Public Prosecutor in the prosecution of offences under the Safety, Health and Environment National Authority Act, the Workplace Safety and Health Act, and the Radiation Protection Act, and their subsidiary legislation.

  • Serving as Secretary and Secretariat to SHENA’s Board of Directors and supporting good corporate governance practices.

  • Serving as a member of the SHENA Legal Notice Committee to ensure legal compliance, consistency, and integrity in the issuance and administration of legal notices.

The Legal Services Division is headed by a Director and supported by a Senior Legal Counsel, Legal Counsel, and Office Assistant. The Division comprises three functional sub-units: (i) Compliance and Policy, (ii) Corporate Affairs, and (iii) Vetting and Translation. Together, these sub-units provide integrated legal, regulatory, governance, policy, and enforcement support to facilitate the effective discharge of SHENA’s statutory, regulatory, and corporate functions.
